The first division bench of Chief Justice Sanjib Banerjee and Justice Senthilkumar Ramamoorthy said that there was no restraint order that could be forwarded in the absence of materials to prove that members of the Association took water only from agricultural wells that were not used, because of non-availability of agricultural labor and problems other related, as claimed by them and not from Borewells. But the judges let it open to the association to highlight their complaints before the official was concerned and pursued this matter with them. In the affidavit, the Secretary of the Association P. Saravanan Kovilabakkam stated that he had 425 members who operated more than 2,000 trucks that supplied water every day to hundreds of housing complexes, information technology companies, and other companies.
